📜 Terms of Service

1. Acceptance

By accessing or using AI Saga, you accept these Terms and any policies referenced here. Certain features may have additional terms that are incorporated by reference.

2. Eligibility

You must be at least 18 (or the age of majority where you live) to use the Service. Accounts registered or used by minors are prohibited.

3. Your Account

You're responsible for your credentials and all activity under your account. Notify us promptly of unauthorized use.

4. Prohibited Content & Conduct

  • No Real‑Person Likeness: Do not upload, generate, or depict real, identifiable people—musicians, band members, actors, politicians, influencers, public or private figures—without their explicit written consent.
  • No minors: Absolutely no content depicting minors (real or generated) in any context; we report suspected child exploitation to authorities.
  • No pornographic content: Sexual content, explicit nudity, or fetish content is prohibited.
  • No harmful misuse: Deepfakes to deceive, scams/fraud, political campaigning/advocacy, misinformation, doxxing, harassment, hate, discrimination, graphic violence, or terrorist content.
  • No IP violations: Don't infringe copyright, trademark, trade dress, privacy, or publicity rights.
  • No abuse of platform: No scraping, reverse engineering, rate abuse, or attempts to bypass security or limits.

Enforcement: We may remove content and suspend or terminate accounts immediately and without refund for violations or suspected violations.

If you upload or depict a real person, you represent and warrant you have their express written consent (model release) and that they are over 18. You agree not to impersonate, and not to imply endorsement.

6. Ownership & Licenses

  • Your Inputs & Outputs: Subject to applicable law and third‑party rights, you own the outputs you generate.
  • License to Us (operational): You grant AI Saga a worldwide, non‑exclusive, royalty‑free license to host, process, transmit, display, and create non‑substantive adaptations of your inputs and outputs solely to operate, maintain, secure, moderate, and improve the Service.
  • Public Sharing: If you publish content publicly on AI Saga, you grant other users a license to view and interact with it as enabled by the Service.
  • Feedback: You grant us a perpetual, royalty‑free license to use suggestions or feedback to improve the Service.

7. Payments, Credits & Refunds

AI Saga uses credits. Purchases are final and non‑refundable except where required by law. Subscriptions automatically renew unless canceled before renewal. We may change prices or offerings prospectively.

8. DMCA, Takedowns & Repeat Infringers

We respect IP rights. Send notices to our DMCA Agent at legal@youarethesongnow.com. We remove infringing content and may terminate repeat infringers.

9. Disclaimers

The Service and all outputs are provided "as is" and "as available," without warranties of any kind, including merchantability, fitness, non‑infringement, or accuracy. AI may produce errors or unexpected results.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability will not exceed the greater of $500 or the amounts you paid in the 3 months preceding the claim.

11. Indemnification

You will defend, indemnify, and hold harmless AI Saga and its affiliates from claims and expenses arising out of your content, use of the Service, or violation of these Terms or law.

12. Changes to the Service & Terms

We may modify or discontinue features and update these Terms. Continued use after changes take effect constitutes acceptance.

13. Dispute Resolution

Arbitration & Class Waiver: Except for small‑claims matters, any dispute will be resolved by binding arbitration under the AAA Consumer Rules in Los Angeles County, California. No class actions. You may opt out within 30 days by emailing legal@youarethesongnow.com with subject "Arbitration Opt‑Out."

Claims must be filed within one (1) year of accrual. Governing law: California, without regard to conflicts principles. Venue for non‑arbitrable disputes: state or federal courts in Los Angeles County.

14. Termination

We may suspend or terminate at any time for violations or risk. Upon termination, licenses to you end, and credits may be forfeited. Provisions that by nature should survive, do.

15. Miscellaneous

No waiver of rights by inaction. If any term is unenforceable, the rest remains effective. You may not assign without our consent; we may assign. Notices may be delivered electronically.
